Employment Act 1955 — Annual Leave Entitlements
Section 60E of the Employment Act 1955 sets the minimum annual leave entitlements for employees in Malaysia. The entitlement is based on continuous years of service with the same employer:

If an employee has not completed 12 months of service in a year, leave is calculated proportionally based on completed months.
Annual leave is separate from public holidays. Malaysia has a minimum of 11 gazetted public holidays per year.
Employees are also entitled to 14-22 days of paid sick leave per year (depending on service length), separate from annual leave.

Under the Employment Act 1955, annual leave is based on years of continuous service: 8 days for less than 2 years, 12 days for 2-5 years, and 16 days for 5+ years. If an employee has not completed a full year of service, leave is pro-rated based on the number of completed months.
The Employment Act 1955 applies to employees whose wages do not exceed RM4,000 per month, as well as manual laborers regardless of wage. However, following the Employment (Amendment) Act 2022, most provisions now apply to all employees. Many employers offer the same or better leave entitlements to all staff.

Under Malaysian law, unused annual leave can be forfeited if not taken within 12 months after the end of the year it was accrued, unless the employer agrees to carry it forward. Employment contracts or company policies may specify carry-forward rules.
When pro-rated leave results in a fraction of a day, Malaysian practice is to round to the nearest whole day. If the fraction is 0.5 or more, it rounds up. If less than 0.5, it rounds down. This calculator follows that convention.
