Overview

What Is an Employer of Record in Indonesia?

An Employer of Record (EOR) is a local entity that legally employs workers in Indonesia on your behalf. RecruitGo's Indonesian entity becomes the legal employer — we sign the employment contract, register employees with BPJS (Indonesia's social security system), withhold and file income tax (PPh 21), and manage all mandatory labor reporting.

You retain full control over the employee's work, schedule, and responsibilities. They report to you, work on your projects, and function as part of your team. We handle everything that Indonesian employment law requires of an employer.

Without EOR: Setting up a PT PMA (foreign-owned company) typically takes 2 to 4 months. Under BKPM Regulation No. 5/2025, the minimum paid-up capital is IDR 2.5 billion (~USD 150,000), with a total investment plan exceeding IDR 10 billion (~USD 640,000) per business activity. EOR Services Indonesia

What Our EOR Service Includes

Every aspect of Indonesian employment law is handled by our in-house Jakarta team. Here is exactly what is included when you hire through RecruitGo's EOR in Indonesia.

01Employment contracts

We draft and execute compliant PKWT (fixed-term) or PKWTT (permanent) contracts under Indonesian labor law. All contracts are bilingual (Bahasa Indonesia and English) and reviewed for current Omnibus Law compliance.

02Payroll processing

Monthly salary calculation, disbursement to local bank accounts in IDR, and payslip generation. We handle gross-to-net calculations including all statutory deductions and employer contributions. You pay one invoice in your preferred currency (USD, AUD, EUR, or GBP).

03BPJS registration and contributions

We register every employee with BPJS Kesehatan (health) and BPJS Ketenagakerjaan (employment security), calculate monthly contributions across all five programs (JHT, JP, JKK, JKM, JKP), and submit payments on time.

04Income tax withholding (PPh 21)

Monthly PPh 21 calculation using the TER (Tarif Efektif Rata-rata) method, withholding, filing by the 20th of the following month, and annual reconciliation. We handle PTKP status changes and year-end SPT filing.

05THR and statutory bonuses

Calculation and disbursement of THR (Tunjangan Hari Raya), the mandatory religious holiday bonus equal to one month salary. Paid at least 7 days before the employee's major religious holiday, prorated for tenure under 12 months.

06Employee onboarding

Full onboarding within 3 to 5 working days: contract execution, BPJS registration, tax ID setup, bank account coordination, and employee handbook. Your team member is legally employed and compliant from day one.

07Leave and benefits administration

Tracking and management of 12 days annual leave, sick leave (with statutory pay reduction schedule), maternity leave (3 months paid), paternity leave (up to 5 days), and 15 public holidays per year.

08Offboarding and severance

We manage the full termination process: bipartite negotiation, severance (pesangon) calculation under the Omnibus Law formula, UPMK and UPH entitlements, final pay settlement, and BPJS deregistration.

09Work permits for foreign employees

For non-Indonesian hires: RPTKA (foreign worker utilization plan) approval, KITAS (limited stay permit) processing, DKP-TKA compensation fund payments (USD 100/month), and counterpart (pendamping) documentation.

10Compliance monitoring

Ongoing monitoring of regulatory changes including Omnibus Law implementing regulations, BPJS rate adjustments, minimum wage updates, and new labor ministry circulars. We adjust contracts and payroll proactively.

Is EOR right for you?

Who Should Use EOR in Indonesia?

EOR is the right fit if you:
Want to hire Indonesian talent without the IDR 10B+ capital required for a PT PMA
Need someone hired in days, not the 6–10 weeks BKPM/OSS registration takes
Building a remote team and don’t need a physical office
Want compliant BPJS and PPh 21 payroll without managing it yourself
Testing the Indonesian market before committing to full incorporation
Running a project-based engagement or scaling a distributed team
Talk to Our Experts
Consider your own entity (PMA) if you:
Need a physical office, warehouse, or manufacturing facility
Want to own Indonesian assets or intellectual property
Operate in a sector on the negative investment list requiring local licenses
Need to sign commercial contracts directly with Indonesian clients or government

⚠ Contractor warning: Indonesia has strict criteria for contractor relationships under PP 35/2021. If the person works set hours, reports to your managers, and does core business functions — that's legally an employee. Misclassification means backdated BPJS, tax penalties, and severance liability.

Employment Contracts

PKWT vs PKWTT: Contract Types in Indonesia

Most common for EOR

PKWT — Fixed-Term

Perjanjian Kerja Waktu Tertentu

Defined-period engagements
Max 5 years incl. renewals
Compensation on completion
Most EOR arrangements use this

PKWTT — Permanent

Perjanjian Kerja Waktu Tidak Tertentu

Open-ended, no fixed end date
Up to 3 months probation
Full severance on termination
Used for long-term roles

Tax & Payroll

Income Tax (PPh 21)

Employers withhold income tax using the TER (Tarif Efektif Rata-rata) method, introduced in 2024. Monthly PPh 21 is filed by the 20th of the following month.

Social Security

BPJS: Indonesia's Mandatory Social Security

BPJS Kesehatan (Health Insurance)

JKP note: The Job Loss Insurance program (0.36% of wages under PP 6/2025, reduced from 0.46%) is not an additional employer cost. It is funded through internal recomposition of JKK and JKM contributions (0.14% from JKK + 0.22% from government). Employers do not pay a separate JKP contribution.

Termination

Severance (Pesangon) in Indonesia

Termination is complex and expensive. Employers cannot unilaterally fire — bipartite negotiation and potentially the Industrial Relations Court are required.

8+ years9 months

Total termination cost can reach 15+ months of salary including UPMK (long-service pay) and UPH (entitlement compensation). Your EOR manages this by setting aside monthly severance provisions.

Immigration

Work Permits & Visas

Indonesian nationals hired through EOR need no work permits — only standard registration. For foreign employees, Indonesia requires:

RPTKA
Rencana Penggunaan Tenaga Kerja Asing
Foreign Worker Utilization Plan — approved before hiring
KITAS
Kartu Izin Tinggal Terbatas
Limited Stay Permit — the primary work visa
DKP-TKA
Compensation fund
USD 100/month per foreign worker, paid in advance

Counterpart requirement: Each foreign worker must have an assigned Indonesian counterpart (pendamping) for knowledge and skills transfer. The employer must document this transfer process, and failure to comply can result in RPTKA revocation.

Frequently Asked Questions

We handle employment contracts (PKWT/PKWTT), payroll processing in IDR, BPJS registration and monthly contributions, PPh 21 tax withholding and filing, THR calculation and payment, leave administration, severance management, work permit processing for foreign employees, and ongoing compliance monitoring. You manage your team's work. We manage everything Indonesian law requires of an employer.

The total cost is your employee's gross salary plus statutory contributions (~10–11% for BPJS), THR provisions (8.33% monthly), a severance reserve, and the EOR management fee (10% of employer cost, min USD 49.99, max USD 250). For a mid-level Jakarta role at IDR 15M/month, total loaded cost is approximately IDR 19–20M.

Typically 3–5 business days from signed agreement to the employee's official start date. This compares to 2–4 months for setting up your own PT PMA.

No. RecruitGo's Indonesian entity becomes the legal employer, so you don't need your own PT PMA. You can operate in Indonesia immediately without the IDR 2.5B paid-up capital requirement.

Yes, but it requires additional steps: an RPTKA (foreign worker plan), KITAS (work visa), and DKP-TKA compensation fund payment of USD 100/month. There is also a 1:10 ratio requirement. We handle the full process.

Through our parent company Emerhub Group, we set up your PT PMA and transfer all employees to your own entity. Most companies start with EOR for 2–12 months before transitioning.

Yes. THR (Tunjangan Hari Raya) is a mandatory religious holiday bonus equal to one month salary for employees with 12+ months of service, or prorated for shorter tenure. It is paid at least 7 days before the religious holiday. We provision for THR monthly so there is no lump-sum surprise.

A staffing agency recruits candidates for you. An EOR legally employs people you have already selected. RecruitGo does not recruit or source talent. You find the person, we become their legal employer in Indonesia and handle all payroll, tax, BPJS, and labor compliance.
